{"id":336391,"date":"2025-10-15T16:01:15","date_gmt":"2025-10-15T12:01:15","guid":{"rendered":"https:\/\/www.meydan.tv\/article\/avropa-m%c9%99hk%c9%99m%c9%99si-jurnalist-ramin-dekonun-sikay%c9%99ti-uzr%c9%99-q%c9%99rar-q%c9%99bul-edib\/"},"modified":"2025-10-15T20:33:15","modified_gmt":"2025-10-15T16:33:15","slug":"european-court-rules-in-favor-of-azerbaijani-journalist-ramin-deko","status":"publish","type":"post","link":"https:\/\/www.meydan.tv\/en\/article\/european-court-rules-in-favor-of-azerbaijani-journalist-ramin-deko\/","title":{"rendered":"European Court rules in favor of Azerbaijani journalist Ramin Deko"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>The European Court of Human Rights has issued another ruling against the Government of Azerbaijan.<\/p>\n\n\n\n<p>The decision concerns an application filed by journalist Ramin Jabrayilzada (Deko), who is currently in prison, regarding freedom of information.<\/p>\n\n\n\n<pre class=\"wp-block-preformatted\">Ramin Jabrayilzada (Deko) was detained on December 6, 2024, in connection with the \u201cMeydan TV case.\u201d<br><br> He was initially charged under Article 206.3.2 of the Criminal Code (smuggling committed by a group of persons acting in collusion), and a court ordered his pretrial detention.<br><br>On August 28, 2025, the charges in the \u201cMeydan TV case\u201d were increased. Currently, 12 people arrested in this case are being charged under seven different articles of the Criminal Code.<\/pre>\n\n\n\n<p>In 2012, Jabrayilzada sent a request for information to the Presidential Administration, asking for the following data:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A list of well-known individuals \u2014 artists, athletes, and officials \u2014 who had been granted apartments by presidential decrees;<\/li>\n\n\n\n<li>The financial sources for these apartments;<\/li>\n\n\n\n<li>Whether the state owned any other housing funds and whether the Baku City Executive Authority had any powers over those funds.<\/li>\n<\/ul>\n\n\n\n<p>The Presidential Administration did not respond to the journalist\u2019s request.<br>Jabrayilzada therefore filed a lawsuit, but the domestic courts rejected his claim.<br>After that, he appealed to the European Court of Human Rights.<\/p>\n\n\n\n<p>In its judgment, the European Court stated that the journalist was fulfilling the function of a \u201cpublic watchdog\u201d and that the requested information was necessary for his professional activities.<br>The Court further noted that the information sought related to an issue of significant public interest, namely the distribution of state-funded apartments to citizens.<\/p>\n\n\n\n<p>In this case, the Presidential Administration neither determined who held the information, nor forwarded the request to the relevant authority, nor responded to the applicant at all.<br>The domestic courts failed to address this inaction and merely stated that the journalist had \u201capplied to the wrong authority.\u201d<\/p>\n\n\n\n<p>The Court concluded that the behavior of the Presidential Administration was \u201cnot prescribed by law\u201d and constituted an interference with the journalist\u2019s freedom of information.<br>Accordingly, the European Court found a violation of Articles 10 (freedom of expression) and 13 (right to an effective remedy) of the European Convention on Human Rights.<\/p>\n\n\n\n<p>The Court also noted that the mere finding of a violation in this case was sufficient compensation for any moral damage the applicant might have suffered, and therefore no monetary compensation was awarded.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The European Court of Human Rights has issued another ruling &#8230; <\/p>\n<p class=\"read-more-container\"><a title=\"European Court rules in favor of Azerbaijani journalist Ramin Deko\" class=\"read-more button\" href=\"https:\/\/www.meydan.tv\/en\/article\/european-court-rules-in-favor-of-azerbaijani-journalist-ramin-deko\/#more-336391\" aria-label=\"Read more about European Court rules in favor of Azerbaijani journalist Ramin Deko\">Read more<\/a><\/p>\n","protected":false},"author":24,"featured_media":326324,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"_sitemap_exclude":false,"_sitemap_priority":"","_sitemap_frequency":"","footnotes":""},"categories":[80,37,38,141],"tags":[125,145,147,142,144],"class_list":["post-336391","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-featured-en","category-news","category-politics","category-the-meydan-tv-case","tag-azerbaijan","tag-free-journalism","tag-government-repression","tag-meydan-tv","tag-press-freedom","infinite-scroll-item","generate-columns","tablet-grid-50","mobile-grid-100","grid-parent","grid-33","no-featured-image-padding"],"acf":[],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.4 -
