{"id":230991,"date":"2022-01-05T21:16:28","date_gmt":"2022-01-05T17:16:28","guid":{"rendered":"https:\/\/www.meydan.tv\/?p=230991"},"modified":"2022-01-05T21:16:30","modified_gmt":"2022-01-05T17:16:30","slug":"prosecutors-office-delays-decision-on-tofig-yagublus-torture-complaint","status":"publish","type":"post","link":"https:\/\/www.meydan.tv\/en\/article\/prosecutors-office-delays-decision-on-tofig-yagublus-torture-complaint\/","title":{"rendered":"Prosecutor&#8217;s office delays decision on Tofig Yagublu&#8217;s torture complaint"},"content":{"rendered":"\n<p><em>Lawyer: &#8220;If there is a decision on rejection, in this case, an appeal will be filed in court to annul it&#8221;<\/em><\/p>\n\n\n\n<p>More than a month has passed since Tofig Yagublu, a member of the Coordination Center of the National Council and the Musavat Party, filed a complaint with the prosecutor&#8217;s office alleging he had been tortured.<\/p>\n\n\n\n<p><meta charset=\"utf-8\">Tofig Yagublu was detained by police in Fountain Square on 1 December during a protest rally in Baku demanding the release of Saleh Rustamli, who was on hunger strike.\u00a0At around 7 pm, he was found in Alat settlement, Garadagh district.\u00a0He had visible marks on his face, especially around his eyes, on his head, and on various parts of his body.\u00a0Yagublu said that the police tortured him into this situation, and then <a href=\"https:\/\/www.meydan.tv\/az\/article\/tofiq-yaqublu-amansizca-doyurduler-ele-bildim-oldurecekler\/\" target=\"_blank\" rel=\"noreferrer noopener\">left him there<\/a>.<\/p>\n\n\n\n<p>There were no reports that a criminal case was opened, or that the police were punished, and with a month having past since the complaint was filed, the Prosecutor&#8217;s office is now late according to Azerbaijan&#8217;s criminal code.<\/p>\n\n\n\n<p>Yagublu&#8217;s lawyer, Nemat Karimli, told Meydan TV that the legislation provides for a period of one month for such cases.\u00a0Article 207 of the Code of Criminal Procedure stipulates that if an expert opinion is required, a preliminary investigation must be conducted within a maximum of 30 days to determine whether there are sufficient grounds for instituting criminal proceedings.\u00a0Depending on the outcome of the inspection, a decision must be made to initiate criminal proceedings or to refuse to initiate criminal proceedings.<\/p>\n\n\n\n<div class=\"wp-block-columns alignwide is-layout-flex wp-container-core-columns-is-layout-9d6595d7 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:50%\">\n<p><meta charset=\"utf-8\">The lawyer of the political activist filed a complaint with the prosecutor&#8217;s office on 2 December.\u00a0On 3 December, he and his lawyer were interrogated at the Sabail District Prosecutor&#8217;s Office and the scene was inspected.<\/p>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:50%\">\n<figure class=\"wp-block-image\"><img decoding=\"async\" width=\"1200\" height=\"675\" data-src=\"https:\/\/www.meydan.tv\/wp-content\/uploads\/\/untitled_design_1_jfqjl0m-1200x675.png\" alt=\"V\u0259kil Nem\u0259t K\u0259rimli\" class=\"wp-image-129995 lazyload\" src=\"data:image\/svg+xml;base64,PHN2ZyB3aWR0aD0iMSIgaGVpZ2h0PSIxIiB4bWxucz0iaHR0cDovL3d3dy53My5vcmcvMjAwMC9zdmciPjwvc3ZnPg==\" style=\"--smush-placeholder-width: 1200px; --smush-placeholder-aspect-ratio: 1200\/675;\" \/><\/figure>\n\n\n\n<p class=\"has-small-font-size\">Image: From Nemat Karimli&#8217;s personal archive<\/p>\n<\/div>\n<\/div>\n\n\n\n<p>Nemat Karimli stressed that due to the expiration of the one-month period, the prosecutor&#8217;s office must submit to them one of two decisions: either a decision to initiate criminal proceedings or a decision to refuse to initiate criminal proceedings.\u00a0The lawyer added that if there is a decision on rejection, in this case, Yagublu can file a lawsuit to annul the decision.<\/p>\n\n\n\n<p>Tofig Yagublu told Meydan TV that he did not expect the prosecutor&#8217;s office to make a fair decision and punish the police officers who beat him:<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>It&#8217;s not worth expecting objectivity from people who commit all kinds of crimes and illegalities to protect a corrupt, illegitimate government.<\/p><cite>Tofig Yagublu<\/cite><\/blockquote>\n\n\n\n<p>&#8220;It is clear that the police are not being punished and my complaint will be rejected.
