\n The Observatory has\u00a0been informed by reliable sources about the ongoing arbitrary detention and\u00a0deterioration of the health condition of
\n
\n Ms.\u00a0Leyla Yunus
\n <\/b>
\n ,\u00a0Director of the Institute for Peace\u00a0and Democracy (IPD) and a member of OMCT General Assembly.<\/p>\n

According to the information received, although the health of Ms. Leyla\u00a0Yunus has deteriorated while in detention, the prison authorities\u00a0in Kurdakhany\u00a0detention facility\u00a0have not allowed her to receive the parcels with\u00a0medication she needs as she suffers from diabetes and kidneys problems.\u00a0However,\u00a0following the visit from delegates of the International Committee of\u00a0the Red Cross (ICRC) on August 12, 2014, she finally got her\u00a0painkiller-injections. Yet she is still not allowed to be hospitalised.<\/p>\n

The Observatory recalls that Ms. Leyla Yunus has been detained since\u00a0July 30, 2014, when she was sentenced to three months pre-trial detention. Her\u00a0husband,
\n
\n Mr.\u00a0Arif\u00a0Yunusov
\n <\/b>
\n , Head of the Conflictology Department of IPD, was also arrested\u00a0on August 5, 2014 and placed in pre-trial detention for three\u00a0months (see\u00a0background information). Mr. Yunusov is also in great need for medical\u00a0treatment as he would be in a pre-stroke condition. In April and May 2014, he\u00a0got two heart attacks and consequently spent several weeks in hospital.<\/p>\n

The\u00a0Observatory also recalls that
\n
\n Rasul\u00a0Jafarov
\n <\/b>
\n , prominent human rights defender engaged in the defence of the\u00a0rights of political prisoners and leader of “Sing for Democracy” and\u00a0“Art for Democracy”, and\u00a0I
\n
\n ntigam Aliyev
\n <\/b>
\n , Head of the Legal\u00a0Enlightenment Society, were arrested respectively on\u00a0August 2 and August 8,\u00a02014 on the basis of spurious accusations, and are also allegedly in need of\u00a0medical support[1]. Mr. Aliyev was initially\u00a0detained in a cell with smokers, yet following the ICRC visit on August 12 he\u00a0was transferred to a more spacious cell.<\/p>\n

The\u00a0Observatory is also concerned about the adequate healthcare and prison\u00a0conditions of other human rights defenders who remain detained in relation to\u00a0their human rights activities, including Mr.
\n
\n Anar Mammadli
\n <\/b>
\n , Chairperson of the Election Monitoring and Democracy\u00a0Studies Centre (EMDSC), and Mr.
\n
\n Bashir\u00a0Suleymani
\n <\/b>
\n , Executive Director of EMDSC, who were arrested on December 16,\u00a02013 and May 26, 2014 respectively. Moreover,
\n
\n Mr.\u00a0Hilal Mammadov
\n <\/b>
\n , a\u00a0defender of the rights of the\u00a0Talysh\u00a0ethnic minority, who suffers\u00a0asthma, is currently detained in one cell with former tubercular patients and\u00a0prisoners suffering hepatitis and other diseases[2].<\/p>\n

The Observatory also remains concerned about the circumstances and\u00a0reasons as to why detained human rights defenders
\n
\n Mr.\u00a0Hasan Huseynli
\n <\/b>
\n ,\u00a0Head of the NGO “Educative Centre ‘Intellectual Citizen'”, and
\n
\n Mr.\u00a0Emil\u00a0Mammadov
\n <\/b>
\n , Head of the NGO \u201cPromoting Democracy\u201d, sent letters on August 6\u00a0to\u00a0President Ilham Aliyev, in which they express support for President Aliyev\u00a0and the army of Azerbaijan. The Observatory strongly fears that they could have\u00a0been subject to pressure in detention[3].<\/p>\n

The\u00a0Observatory expresses its deep concern about the ongoing detention and denial\u00a0of effective medical care to Ms. Leyla Yunus and Mr. Arif Yunusov, which put\u00a0their health at serious risk, as well as about the condition of the\u00a0other\u00a0above-mentioned human rights defenders. Accordingly, the Observatory\u00a0calls upon\u00a0the authorities in\u00a0Azerbaijan to provide adequate medical care to them as well as to\u00a0release them immediately and unconditionally,\u00a0as their\u00a0detention seems to only aim at sanctioning their activities amidst a wave of\u00a0increasing repression against civil society organisations and representatives\u00a0in\u00a0Azerbaijan.\n<\/p>\n

\n Action requested:
\n <\/b><\/p>\n

Please\u00a0write to the authorities in\u00a0Azerbaijan,\u00a0urging them to:<\/p>\n

i.\u00a0 \u00a0 \u00a0 \u00a0\u00a0Guarantee in all\u00a0circumstances the physical and psychological integrity of Ms. Leyla Yunus, Mr.\u00a0Arif Yunusov and all the above-mentioned human rights defenders in Azerbaijan;<\/p>\n

ii.\u00a0 \u00a0 \u00a0\u00a0Provide urgently adequate medical care to Ms. Leyla Yunus and Mr. Arif\u00a0Yunusov, including medication and hospitalisation;<\/p>\n

iii.\u00a0 \u00a0 \u00a0Immediately and unconditionally release Ms. Leyla Yunus and Mr. Arif\u00a0Yunusov from pre-trial detention, as well as all the\u00a0other\u00a0above-mentioned human rights defenders, since their\u00a0detention is arbitrary as it only aims at sanctioning their human rights\u00a0activities;<\/p>\n

iv.\u00a0 \u00a0 \u00a0Put an end to any kind of harassment – including at the judicial and\u00a0investigatory levels – against Ms. Leyla Yunus, Mr. Arif Yunusov, and more\u00a0generally against all human rights defenders in Azerbaijan;<\/p>\n

v.\u00a0 \u00a0 \u00a0 \u00a0Conform with the provisions of the UN Declaration on Human Rights\u00a0Defenders, adopted by the General Assembly of the United Nations on December 9,\u00a01998, especially:
\n
\n –\u00a0 \u00a0 \u00a0 \u00a0\u00a0Article 1, which states\u00a0that \u201ceveryone has the right, individually and in association with others, to promote\u00a0and to strive for the protection and realisation of human rights and\u00a0fundamental freedoms at the national and international levels\u201d;
\n
\n – \u00a0 \u00a0 \u00a0\u00a0\u00a0Article 5, which\u00a0underscores the right of every individual to form, join, and participate in\u00a0non-governmental organizations; and
\n
\n –\u00a0 \u00a0 \u00a0 \u00a0\u00a0Article 12.2, which\u00a0provides that the State shall \u201ctake all necessary measures to ensure the\u00a0protection by the competent authorities of everyone, individually and in\u00a0association with others, against any violence, threats, retaliation, de facto\u00a0or de jure adverse discrimination, pressure or any other\u00a0arbitrary action as a\u00a0consequence of his or her legitimate exercise of his or her rights\u201d;<\/p>\n

vi.\u00a0 \u00a0 \u00a0Ensure in all circumstances respect for human rights and fundamental\u00a0freedoms in accordance with international human rights standards and\u00a0international instruments ratified by\u00a0Azerbaijan.<\/p>\n
